Welcome to Heavenly Church Websites, a subsidiary of BrandFlare Creative. These Terms and Conditions (“Terms”) govern your access to and use of our website design and maintenance services. By using our services, you agree to comply with and be bound by the following Terms.

1. Services Provided

Heavenly Church Websites offers website design, development, and ongoing maintenance services specifically tailored for churches and ministries. Some of our plans include features such as “Unlimited Updates,” “Unlimited Pages,” and/or “Unlimited Blog Posts,” which are governed by our Reasonable Use Policy (see Section 5).

2. Eligibility

You must be at least 18 years old to use our services. By entering into an agreement with us, you represent that you have the authority to bind the organization you represent.

3. Payment and Billing

Payments are due according to the selected service plan. Services are typically billed monthly or annually. If a payment is missed or declined, your website or service access may be paused or terminated until the account is brought current.

All fees are subject to change with notice. Heavenly Church Websites reserves the right to revise its pricing structure at any time. Changes to recurring plans will take effect upon the next billing cycle after notice is given.

4. Intellectual Property

All content you provide remains your property. Any original designs, code, templates, or creative work developed by Heavenly Church Websites remain the intellectual property of BrandFlare Creative and are licensed to you for use on your site as long as your service remains active.

You agree not to copy, reuse, or resell our proprietary assets without prior written permission.

5. Reasonable Use Policy

We are proud to offer high-value services such as “Unlimited Updates,” “Unlimited Pages,” and “Unlimited Blog Posts” in select packages. These offerings are subject to the following Reasonable Use Policy to ensure fair use and reliable service for all clients.

What Qualifies as an “Update”

Covered updates typically include:

      • Adding, editing, or removing text and images

      • Uploading blog posts, sermons, or other content (provided by you)

      • Adjusting layouts or styles within the existing theme

      • Creating or updating web pages or blog posts

      • Updating forms, plugin content, or calendars

Updates do not include:

      • Complete site redesigns

      • Custom development or third-party integrations

      • Branding or logo design work

      • Advanced SEO campaigns

      • Full content writing or editing

      • Extensive data entry, formatting, or spreadsheet-based uploads

Unlimited Pages & Blog Posts

If your plan includes unlimited pages or blog posts:

      • You may request as many new pages or posts as needed

      • You must provide the content to be added in a reasonably final form

      • Large uploads or formatting-heavy tasks may be scheduled or billed separately

Content Submission Guidelines

To help us serve you efficiently:

      • Please submit content that is grammatically correct and spell-checked to a reasonable standard

      • While we may make light edits, content requiring significant rewriting, proofreading, or formatting may be returned or quoted as a separate content-editing service

What “Unlimited” Means

You may request updates at any time, and most will be completed within 1–3 business days depending on complexity. However:

      • Requests should be submitted one at a time unless otherwise agreed

      • Excessive use—typically more than 3–5 hours/month—may prompt a usage review

      • Tasks that exceed normal support expectations may be quoted separately

Abuse of Service

We may delay, limit, or deny requests if we determine that:

      • The service is being used beyond intended scope

      • You are submitting excessive requests with unreasonable editing demands

      • Content is regularly incomplete, unready, or low quality

      • You are attempting to substitute unlimited updates for new development work

We’ll always attempt to communicate first and offer fair solutions, including upgraded plans or custom project quotes.

6. Modifications to Services and Pricing

Heavenly Church Websites reserves the right to modify, discontinue, or revise any part of our service offerings or pricing structure at any time. Changes will be communicated via email or website notice and will apply moving forward from the date of notice.

7. Cancellations & Refunds

You may cancel your service at any time by notifying us in writing. Prepaid fees are non-refundable unless otherwise specified. Your site will remain live until the end of the current billing cycle unless alternative arrangements are made.

8. Limitation of Liability

In no event shall Heavenly Church Websites or BrandFlare Creative be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of data, loss of revenue, or service interruption. Our total liability for any claim shall not exceed the amount paid by you in the preceding three (3) months.

9. Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles. You agree to resolve any disputes with us in the jurisdiction of our principal place of business.
